It is also essential because, although the sale may appear simple at first glance as it is based on a simple declaration of intent between vendor and purchaser, its implementation has become more complex over the years. It requires knowledge of the provisions of civil law, tax law, rural law, urban planning and construction law, etc.<\/p>\n\n\n\n<p>The notary ensures that an effective contract is put in place, while paying particular attention to the concerns of both the vendor and the purchaser. He carries out a detailed study, from the opening of the file on, until the final formalities following the signature of the deed. <\/p>\n<\/div>\n<\/div>\n\n\n\n<p>Drafting a preliminary contract or a vendor\u2019s promise by a notary allows to determine the essential terms of the sale and to prepare the final deed efficiently. In particular, the notary advises the vendor and the purchaser on the scope of their commitments and the precautions that should be taken. The transfer of ownership takes place on the day of the signing of the sales deed, so that all the legal and administrative documentation can be gathered until this date.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">The Notary\u2019s missions<\/h3>\n\n\n\n<p>Generally speaking, the notary ensures that both the vendor and the purchaser have the necessary capacity to enter into the contract.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>He checks the legal status of the property, how it can be accessed, as well as any possible neighbourhood or planning constraints.<\/li>\n\n\n\n<li>He examines the title deeds in detail to identify any special rights or obligations: preferential rights, easements, interventions of co-owners, interventions of donees, etc.\u00a0\u00a0<\/li>\n\n\n\n<li>He consults the property register to ensure that the owner is able to sell the property freely and that any possible mortgage registrations can be removed.<\/li>\n\n\n\n<li>He ensures compliance with the administrative and legal regulations applicable to the sale of each type of property by collecting all official documents (town planning certificate, alignment certificate, risk prevention plans, etc.) and compulsory papers (file of technical expert\u2019s reports, co-ownership documents).
