Services regulated by collective agreement 

A new tariff was introduced by the decree of 26 February 2016 determining the regulated tariffs for notaries in application of law n° 2015-990 of 6 August 2015 on growth, activity and equality of economic opportunities, and by the decree n°2016-230 of 26 February 2016 on the fees of certain legal professionals and on inter-professional funds for access to law and justice.

This public tariff applies to the main services provided by notaries (property sales, mortgaging, gifts, marriage contracts, partition, deeds of inheritance, inheritance declarations, etc.).

Freely agreed fees for certain services

Some of the notary’s services are not included in the list of services for which the tariff is applicable (for example commercial leases, company deeds, deeds concerning businesses or legal advice). These services give rise to a fee freely agreed between the notary and his client.

The same applies to client consultations relating to services that can be detached from the preparation, drafting or execution of the deed. This remuneration is called “fees”.

Article L444-1 of the French Commercial Code stipulates that these fees must be set in a written agreement between the notary and his client.
