These funding needs might be linked to the signing of another document, for example projects which include a loan. This will typically be the case for a purchase transaction. However, the loan may also form part of a separate application, for example a refinancing project, an extension of guarantees, debt consolidation or a home improvement loan.

The support process

We often get involved at an early stage so that we can provide our clients with the best possible advice on their financing options.

This is followed by the review of loan offers or proposals and financing agreements submitted by financial institutions or fellow practitioners, as well as the drafting of security agreements.

In a third step, the notarial deed is signed regarding mortgage guarantees, sureties and pledges, as well as the granting of credit facilities, property leases and the assignment of receivables. Once the deed has been signed, our support team handles the formalities for registering the security interests taken, whether in respect of immovable or movable property.

Eventually, our involvement may resume later, once the loan has been repaid, through the relevant discharge deeds and applications for the removal of related entries.This long-term support requires in-depth and constantly updated knowledge of the matter. The latter has undergone substantial changes following the entry into force of order n° 2021-1192 of 15 September 2021 reforming security law.
